Takeabreath.mu shall not be liable in anyway whatsoever for any omission and/or commission of negligence, fraud, larceny, personal injury and/or any other “faute” whatsoever in the course of services provided for by the service provider or its “préposé”.

“Service Provider” means the provider of transportation (e.g. car rentals, airport rides, bus) and includes any other tourist’s attraction and events or related service as from time to time shall be available for Reservation on the Platform.
Through the present platform, takeabreath.mu provides an online platform through which Service Providers, in their professional conduct of business can advertise, market, sell, promote, and/or offer their service for order, purchase, a reservation, rent, or hire, and through which relevant visitors of the Platform can discover, search, compare, and make an order, reservation, purchase, or payment. By making an order, purchase, a reservation, rent or hire you enter into a direct contractual relationship with the Service Provider. Takeabreath.mu acts solely as an intermediary between you and the Service Provider, transmitting the relevant details of your order, purchase, reservation, rent or hire to the relevant service provider(s) and sending you a confirmation email for and on behalf of the service provider. Takeabreath.mu does not sell, rent, or offer service directly to clients and as such, shall not be accountable and/or liable.
The information that we disclose is obtained and based on the information provided to us by service providers, who advertised on our platform. As such, it is the service providers that market and promote their services on the platform and they are fully responsible for updating all rates/fees/prices, availability, policies, conditions, and other relevant information that gets displayed on our Platform. Although we will use reasonable skill and care, we cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade, or maintenance of our Platform or otherwise), inaccurate, misleading, or untrue information, nor non-delivery of information. Moreover, you undertake to hold harmless takeabreath.mu and/or its directors, officers, ‘préposés’ and agents, and/or its holding, subsidiary and sister companies and/or their directors, officers, ‘préposés’ and agents, acting in such capacities or in their personal names of any claims arising out of or in connection with the services provided by the service providers.

By purchasing, reserving, renting, or hiring the services of the service providers via takeabreath.mu, you hereby consent to takeabreath.mu collecting, recording, and processing your personal data to process your orders, ease and facilitate check-in and follow up with service providers. All data is collected lawfully, in accordance with the Data Protection Act.
The terms herein will be governed by and construed in accordance with the laws of Republic of Mauritius. The Courts of Mauritius shall have exclusive jurisdiction over any dispute.
